How can I obtain a Permit to keep my 5 pnd chihuahua, in my current apartment?
I live at my current residence for 22 yrs during this time I have had cats come and go. When the owner passed away the building went to an agency at this time I had no pet. In there lease it says no pets, understandable. Last year I asked my property manager if there were any exceptions on having pets he said he would ask the office, he asked and I called the office what was the company policy. I was told by both the office and my property manger that I needed to fill out a pet agreement form and a $300 deposit of which I was excited and said yes to. I handed my app and told him that as soon as he gave me my signed copy by the office I would give him the check. I had not yet even decided what I wanted to get I just wanted to do everything by the book to avoid issues in the future. I got Jade in Dec and have had her till today and my property manager calls me and tells me that there has been a mistake and I have to get rid of her! The office says they made a mistake. HELP!
As for you, you have a signed document and made payment. There was a legal exception made for one reason or another. If on one hand, this is simply for a pet and not for one of the many, many types of assisted (helper, aide, service… ) animals, then your landlord agreed on a price, which I believe you have paid and it is now legal. BUT, I am disabled an am still in court fighting for the rights of the tenants I no longer live with and what was done to me. The other tenants refused to fight due to fear of retribution such as I experienced. If you dog is, in fact a dog used for medical reasons, you are due you $300.00 back immediately, plus interest, if any is due. No one pays a deposit for assistive animals.
Please read some of the information below, but in view of your circumstances, it would be best to go to your area Legal aide or hire a private attorney.
It depends on the type of apartment you live in. If it is Government assisted, prior to the new President, the were many ways you were able to do this. Look in the Department of Justice/other agencies/ADA and Fairhousing. There was a bill signed into law by Bush to make apartment complexes “family orientated” by allowing domestic animals.
Also, could you not (prior to new president) to be forced to give up you pet(s) when moving into assisted living, nursing homes, Government subsidized apartments, etc. Also look up for recent changes as of the new president. On January 1, 2009, President Bush placed into act a strong and necessary new set of laws and rules for animals in apartment complexes.
If you are disabled, you cannot be refused your service animal unless that animal does not meet the needs of the disabilities companion it should be helping (despite common thought, THERE IS NO SUCH THING AS CERTIFIED AND LICENSED SERVICE ANIMAL TRAINERS; HENCE ANIMAL WLL NOT BE CERTFIED
AND LICENSED)
Unfortunately, we now have a president that has already set the export prices on body parts of babies (Good Catholic) and he may have completely abolished assisted needs for the elderly and disabled, as well as the removal of all pets, despite hardships.
It is best to read the newest version of THE LANDLORD AND TENANT ACT, as well as the rules and laws that may have changed recently within the Department of Justice under the ADA and the Fairhousing Act and Fairhousing Guides. We don’t want our pets sold off too foreigners to be used as spare parts, like our miscarried babies. (aborted, cloned babies)
Please note, these are not the words or ideas expressed by this Website,
but I am Sadie Marie and I will stand behind then, as acurrate as of the
week of March 8, 2009.
